Scope of application
The following General Terms and Conditions (GTC) apply to all orders placed through our website. The offer on this website is exclusively aimed
to consumers residing in Switzerland (hereinafter "Customer").
A consumer is defined as a natural person who maintains business relations with COCO TAN that cannot be attributed to their commercial or independent professional activity. Orders in quantities not typical for household use may be rejected without justification.
COCO TAN reserves the right to change these Terms and Conditions at any time. The version of these Terms and Conditions valid at the time of the order is decisive and cannot be unilaterally changed for this order. Conflicting or deviating conditions of the customer are not recognized.

COCO TAN contains information about products and services. Price and assortment changes as well as technical changes are reserved. All information on www.cocotan.ch (product descriptions, images, illustrations, videos, dimensions, weights, technical specifications, accessory relationships, and other information) serve for illustration purposes and are to be understood as approximate values and are non-binding. They do not constitute any assurance of properties or guarantees unless explicitly stated otherwise. COCO TAN strives to provide all information on this website correctly, completely, up-to-date, and clearly, but COCO TAN cannot guarantee this either explicitly or implicitly. All offers on this website are non-binding and are not to be understood as binding offers.
COCO TAN cannot guarantee that the listed products are available at the time of order. Therefore, all information on availability and delivery times is without guarantee and may change at any time without notice.
Prices
The sales prices indicated on COCO TAN are final prices and include, unless otherwise noted, the statutory value-added tax and any other statutory charges such as advance recycling fees (VRG) or copyright fees for electronic devices. The prices are net prices in Swiss Francs (CHF).
Any shipping costs will be charged additionally unless otherwise specified and are to be paid by the customer. Shipping costs are shown separately during the ordering process.
Technical changes, errors, and printing mistakes are reserved, in particular COCO TAN may make price changes at any time and without prior notice. Advisory and support services are not included in the sales prices.
Conclusion of contract
The products and prices on this website are non-binding offers. By placing an order through this website including acceptance of these Terms and Conditions, the customer makes a legally binding offer to conclude a contract. COCO TAN then sends an automatic order confirmation by email, confirming that the customer's offer has been received by COCO TAN. Orders placed are binding for the customer. The return and cancellation provisions according to the return and exchange policies published on the website apply.
The contract is concluded as soon as COCO TAN sends a declaration of acceptance by email, confirming the shipment of the ordered products or services. Orders will only be shipped after full payment has been received (exception: delivery against invoice) and provided the goods are available. If it turns out that the ordered goods cannot be delivered in whole or in part, COCO TAN is entitled not to accept or only partially accept or execute the order. In such a case, COCO TAN will inform the customer by email. If the customer's payment has already been received by COCO TAN , the payment will be refunded to the customer. If no payment has yet been made, the customer will be released from the payment obligation.
Payment methods and retention of title
The payment methods specified during the ordering process are available to the customer.
COCO TAN reserves the right to exclude customers from certain payment methods without giving reasons or to require prepayment.
COCO TAN may charge default interest of 5% per year and a reminder fee of up to CHF 20.- per reminder in case of customer default.
The products delivered to the customer remain the property of COCO TAN until full payment is made.
Delivery, inspection obligation, complaint of defects, and return
Deliveries are sent by post or courier service to the address provided by the customer in the order.
COCO TAN strives to meet the shortest possible delivery times. However, any delivery times specified in the order confirmation are non-binding. COCO TAN is entitled to make partial deliveries. In this case, shipping costs will only be charged to the customer once.
The invoice, if delivery on account is offered, will be sent at the discretion of COCO TAN by email or by post.
If the delivery is undeliverable or the customer refuses to accept the delivery, COCO TAN may terminate the contract after notifying the customer by email and granting a reasonable grace period, as well as charge the customer for the costs of the efforts.
The customer is obliged to check the delivered goods immediately upon receipt of the delivery and to report any defects for which COCO TAN provides warranty immediately in writing via email to support@cocotan.ch .
Returns to COCO TAN are made at the customer's expense and risk. The customer must send the goods in their original packaging, complete with all accessories, along with the delivery note and a detailed description of the defects according to the instructions described on the return and exchange page .
If the inspection by COCO TAN shows that the goods have no detectable defects or these do not fall under the manufacturer's warranty, COCO TAN may charge the customer for the efforts, the return shipment, or any disposal.
Right of withdrawal
The customer is granted a right of withdrawal of 35 days from the order date.
The deadline is considered met if the withdrawal is made within this period
exclusively via the return process specified on the website
is submitted. Withdrawal does not require a reason.
Exercising the right of withdrawal leads to a reversal of the contract.
The customer is obliged to return the goods within 35 days of the order date
according to the instructions described on the return and exchange page
to be returned. Returns are made at the customer's expense and risk.
For items purchased with a discount of up to 40%, a
refund will be made via the originally used payment method.
For items purchased with a discount of more than 40%, a
the refund exclusively in the form of a store credit. The store credit
is valid indefinitely and redeemable in the COCO TAN online shop.
COCO TAN reserves the right to claim reasonable compensation for damages, excessive wear, or loss of value due to improper handling and to deduct the depreciation from the already paid purchase price or charge it to the customer.
In the following cases, no right of withdrawal is granted:
(i) When the contract has an element of chance, namely because the price is subject to fluctuations beyond the provider's control;
(ii) When the contract concerns a movable item that, due to its nature, is not suitable for return or can spoil quickly;
(iii) When the contract concerns a movable item that is made according to the customer's specifications or clearly tailored to personal needs;
(iv) When the contract concerns digital content and this content is not provided on a tangible medium or when the contract is to be fully performed immediately by both parties;
(v) When the contract concerns a service and the contract is to be fully performed by the provider with the prior explicit consent of the customer before the withdrawal period expires.
(vi) In the areas of accommodation, transportation, delivery of food and beverages, as well as leisure activities, when the provider commits at the time of contract conclusion to provide the services at a specific time or within a precisely specified period.
Warranty
COCO TAN strives to deliver goods of impeccable quality. For defects reported in a timely manner, COCO TAN assumes warranty liability during the statutory warranty period, usually two years from the delivery date, for the defect-free condition and functionality of the item purchased by the customer. It is at COCO TAN's discretion to fulfill the warranty through free repair, equivalent replacement, or refund of the purchase price. Further warranty rights are excluded.
Warranty does not cover normal wear and tear as well as the consequences of improper handling or damage by the customer or third parties, as well as defects caused by external circumstances. Warranty is also excluded for consumable and wear parts (e.g., batteries, accumulators, etc.).
COCO TAN is unable to provide assurances or guarantees regarding the timeliness, completeness, and correctness of the data as well as the constant or uninterrupted availability of the website, its functionalities, integrated hyperlinks, and other content. In particular, it is neither assured nor guaranteed that the use of the website does not infringe rights of third parties not owned by COCO TAN .
Liability
COCO TAN excludes any liability, regardless of the legal basis, as well as claims for damages against COCO TAN and any auxiliaries and vicarious agents. COCO TAN is in particular not liable for indirect damages and
Consequential damages, lost profits, or other personal, property, and pure financial losses of the customer. A further mandatory statutory liability remains reserved, for example for gross negligence or unlawful intent.
COCO TAN uses hyperlinks solely to simplify the customer's access to other web offerings. COCO TAN cannot know the content of these web offerings in detail, nor assume liability or any other responsibility for the content of these websites.
Data Protection
COCO TAN may process and use the data collected in the course of concluding the contract to fulfill the obligations arising from the purchase contract and also use it for marketing purposes. The data necessary for performance may also be passed on to commissioned service partners (logistics partners) or other third parties.

Severability
Should individual provisions of these Terms and Conditions prove to be invalid or unenforceable or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
Further Provisions
COCO TAN expressly reserves the right to change these Terms and Conditions at any time and to put them into effect without prior notice.
In case of disputes, exclusively substantive Swiss law shall apply, excluding conflict of law rules. The UN Sales Convention (CISG, Vienna Sales Law) is explicitly excluded.
The place of jurisdiction is Basel-Stadt of COCO TAN or the residence of the consumer.
